Terms of Service
Effective 13 October 2026
These Terms of Service (the “Terms”) are an agreement between you and Shipmates (“we,” “us,” or “our”). They govern your use of our website, job board, emails, job posting tools, call request forms and any other services we offer (together, the “Service”).
By using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service. If you use the Service for a company or other organization, you agree to these Terms for it and confirm that you have authority to do so.
1. Who may use the Service
You must be at least 18 years old, or the age of majority where you live, to use the Service.
2. The job board
Shipmates lists jobs. We decide which kinds of roles, employers and locations to list, and may change that at any time. Listings may come from employers’ public careers pages and job systems, from links that employers send us, or from other sources.
- We are not the employer. We are not an employer, recruiter, staffing agency or agent for any employer or job seeker, and we take no part in hiring decisions. A listing is not an endorsement of the employer or the role.
- Listings may be wrong. Listings come from third parties and may be inaccurate, incomplete, out of date or already filled. Details such as pay, location, work arrangement, employment type and posting date are read from the employer’s posting automatically and may be wrong. Confirm anything important with the employer before you rely on it.
- You apply with the employer. Apply links take you to the employer’s own website. The employer’s terms and privacy policy govern your application.
- We decide what is listed. We may add, edit, classify, hide or remove any listing at any time, for any reason.
- Ads and promoted listings. The Service and our emails may include advertising, sponsored content, and listings that employers or others pay to post, feature or promote. We decide where and how they appear.
3. Posting a job
When you send us a link to a job post or careers page, you confirm that:
- you are authorized to act for the employer, and the email address you give is yours;
- the roles are real, open positions with the employer named; and
- the postings comply with applicable law, including laws against discrimination and laws that require pay ranges or benefits to be disclosed in job postings.
You allow us to visit the link you send and to keep checking it for new, changed and closed roles. You grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to copy, store, display, format, summarize, classify and distribute the content of your postings on the Service, in our emails and in promoting the Service.
We may decline or remove any posting. To ask us to remove a listing or stop checking your careers page, email [email protected] or use our contact form.
4. Emails
If you give us your email address, we may send you emails about the Service, including job listings, updates, announcements and marketing, as often as we choose. You can unsubscribe using the link in our emails. We may change or stop any email at any time.
5. Coaching and hiring advice
- A call request is not an engagement. Asking to book a call does not create a client relationship or commit either of us to anything. Any coaching or advisory services, and their fees, schedule and other terms, will be agreed separately in writing. If that agreement conflicts with these Terms, that agreement controls for those services.
- Guidance, not professional advice. Coaching and hiring advice are for informational and educational purposes. They are not legal, tax, financial, immigration, employment-law or mental health advice, and they are not a substitute for a licensed professional.
- No guaranteed results. We do not guarantee any outcome, such as a job, an offer, a promotion, a level of pay, or a successful hire.
- Your decisions are yours. You are responsible for your own career and hiring decisions, and for complying with the laws that apply to them.
6. Fees
Parts of the Service that cost nothing today may not stay that way. We may, at any time and in our sole discretion, begin charging for any part of the Service, or limit how much of it is available without charge, including browsing or applying to listings, posting jobs, featuring or promoting listings, advertising, emails, coaching, hiring advice and any new features. Fees may be one-time, recurring or by subscription. We may also change or increase any fee at any time.
A new or changed fee applies only from the time it takes effect, never to your use before then. We will tell you the fee before you incur it, and you will not be charged unless you agree to pay it. If you don’t accept a fee, your remedy is to stop using the part of the Service it applies to.
Unless we say otherwise, fees are in U.S. dollars, do not include taxes, and are non-refundable except where the law requires a refund.
7. Your conduct
When you use the Service, you agree not to:
- break any law or violate anyone’s rights;
- give false or misleading information, or pretend to be someone else;
- submit fake jobs, jobs that require applicants to pay, pyramid or multi-level marketing schemes, or postings that discriminate unlawfully;
- use our forms to send spam or unsolicited marketing;
- access the Service by automated means in a way that ignores our robots.txt file or places an unreasonable load on the Service, or copy a substantial part of our listings to build a competing service;
- probe, scan or test the Service for vulnerabilities, or get around its security measures or limits; or
- interfere with the Service or anyone else’s use of it.
8. Intellectual property
The Service, including its design, text, graphics, software, the Shipmates name and mark, and the selection and arrangement of its listings, belongs to us or our licensors and is protected by intellectual property laws. Subject to these Terms, we give you a limited, revocable, non-exclusive, non-transferable license to use the Service to look for work, to manage your company’s listings, or to learn about our services.
Job descriptions, company names, logos and trademarks belong to their owners. Their appearance on the Service does not mean that their owners are affiliated with us or endorse us.
If you send us ideas or feedback about the Service, we may use them without restriction or payment to you.
9. Copyright complaints
If you believe that material on the Service infringes your copyright, email [email protected] with: a description of the copyrighted work; the material you believe infringes it and where it appears on the Service; your name, address, telephone number and email address; a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner; and your physical or electronic signature. We may remove the material and, where appropriate, end the access of anyone who repeatedly infringes.
10. Other websites
The Service links to employers’ websites and other sites we don’t control. We are not responsible for their content, policies or practices, and your use of them is at your own risk.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT ANY LISTING IS ACCURATE, CURRENT OR STILL AVAILABLE.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SHIPMATES AND ITS OWNERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR EMPLOYMENT OPPORTUNITIES, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF WE HAVE BEEN TOLD SUCH DAMAGES ARE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Some places do not allow these limits, so they apply to you only to the extent the law allows. A separate written agreement for coaching or advisory services may set its own limits, which control for those services.
13. Indemnity
To the extent the law allows, you will defend, indemnify and hold harmless Shipmates and its owners, employees and agents from any claims, losses, damages and expenses, including reasonable attorneys’ fees, arising out of your use of the Service, anything you submit to it (including job postings), or your violation of these Terms or the law.
14. Suspension and termination
You may stop using the Service at any time. We may suspend or end your access to all or part of the Service at any time, with or without notice, including if we believe you have violated these Terms. We may also change or discontinue any part of the Service. Sections that by their nature should survive termination, including Sections 6 and 8 through 13 and 15, and any fees you owe, will survive.
15. Governing law and disputes
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Colorado, without regard to its conflict of laws rules.
Before filing a claim, you agree to contact us at [email protected] and try to resolve the dispute informally for at least 30 days. If we can’t resolve it, the dispute will be heard only in the state or federal courts located in Colorado, and you and we consent to the personal jurisdiction of those courts. Either party may bring an eligible claim in small claims court, and either party may seek an injunction in any court with jurisdiction to protect its intellectual property.
16. Changes to these Terms
We may change these Terms at any time. Changes take effect when we post them here. If you keep using the Service after a change, you accept the updated Terms.
17. General terms
These Terms, together with our Privacy Policy and any separate written agreement for services, are the entire agreement between you and us about the Service. If any part of these Terms is found unenforceable, the rest remains in effect. If we don’t enforce a provision, we are not waiving our right to enforce it later. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is responsible for delays or failures caused by events beyond its reasonable control. We may send you notices by email or by posting them on the Service.
